Section 1. Acceptance of These Terms

 

Glendos is a location scouting application for photographers,

operated by Kubay Studio LLC ("Glendos," "we," "us," or "our").

By creating an account or using the Glendos app or website, you

agree to these Terms of Use. If you do not agree, do not use

Glendos.

 

Section 2. Eligibility

 

You must be at least 13 years old to use Glendos. By using the

app you represent that you meet this requirement and that the

information you provide is accurate.

 

Section 3. Accounts

 

Glendos offers three account types: Viewer, Photographer, and

Venue Owner. Photographer and Venue Owner accounts require email

verification before content can be published. You are responsible

for maintaining the security of your account credentials and for

all activity that occurs under your account.

 

Section 4. User Content

 

Glendos is a user-generated content platform. Photographers and

Venue Owners submit photographs, location pins, descriptions, and

related information ("User Content").

 

You retain ownership of the User Content you submit. By

submitting it, you grant Glendos a non-exclusive, worldwide,

royalty-free license to host, store, display, reproduce, and

distribute that content within the app and in connection with

promoting the service.

 

You represent that you own or have the necessary rights to all

User Content you submit, and that it does not infringe the rights

of any third party.

 

Section 5. Objectionable Content and Abusive Behavior

 

Glendos has zero tolerance for objectionable content or abusive

users. You agree not to submit content that is:

 

- Unlawful, harassing, threatening, hateful, or discriminatory

- Sexually explicit or pornographic

- Violent, graphic, or intended to shock

- Infringing on any copyright, trademark, or privacy right

- False, misleading, or impersonating another person

- Spam, advertising, or commercial solicitation unrelated to

  photography locations

 

Users can report objectionable content and block abusive users

from within the app. We review reports and will remove violating

content and terminate the accounts of violating users within 24

hours of receiving a report.

 

We also use automated moderation to screen submitted images. We

may remove or decline any content at our sole discretion.

 

Section 6. Photographs and Saving

 

Photographs displayed in Glendos may be saved only to a mood board

inside the app. Glendos does not provide any function to download,

export, or save photographs to your device. You may not copy,

screenshot for redistribution, scrape, or otherwise reproduce

another user's photographs outside of Glendos without that user's

permission.

 

Section 7. Location Information and Disclaimer

 

This section is important. Read it.

 

Location pins in Glendos are submitted by other users. Glendos

does not create, verify, inspect, or confirm any location, its

coordinates, its accuracy, its safety, its ownership, or whether

access to it is permitted.

 

Glendos takes no responsibility for any location placed by

another user.

 

Locations may be inaccurate, outdated, on private property,

restricted, gated, dangerous, or subject to permits, fees, or

seasonal closures. Information about access, hours, permits, or

contacts is supplied by users and may be wrong.

 

It is your responsibility, before visiting any location, to

confirm that you are legally permitted to be there, to obtain any

required permission, permit, or license, and to assess the safety

of the site and of any activity you conduct there.

 

You use location information at your own risk. Glendos is not

liable for trespass, injury, property damage, fines, citations,

arrest, loss, or any other consequence arising from your visit to

or use of any location found through the app.

 

Section 8. Intellectual Property

 

The Glendos name, logo, app design, and software are owned by

Kubay Studio LLC and are protected by intellectual property law.

You may not copy, modify, reverse engineer, or create derivative

works from the app.

 

Section 9. Termination

 

You may delete your account at any time from within the app. We

may suspend or terminate your account at any time, with or

without notice, if you violate these Terms.

 

Section 10. Disclaimer of Warranties

 

Glendos is provided "as is" and "as available," without

warranties of any kind, express or implied, including any implied

warranty of merchantability, fitness for a particular purpose, or

non-infringement. We do not warrant that the app will be

uninterrupted, error-free, or that any content within it is

accurate.

 

Section 11. Limitation of Liability

 

To the maximum extent permitted by law, Kubay Studio LLC will not

be liable for any indirect, incidental, special, consequential,

or punitive damages, or for any loss of profits, data, or

goodwill, arising out of your use of Glendos. Our total liability

for any claim relating to Glendos will not exceed one hundred

dollars.

 

Section 12. Indemnification

 

You agree to indemnify and hold harmless Kubay Studio LLC from any

claim, demand, loss, or expense, including reasonable attorneys'

fees, arising out of your User Content, your use of Glendos, or

your violation of these Terms.

 

Section 13. Changes to These Terms

 

We may update these Terms from time to time. The "Last updated"

date above reflects the most recent version. Continued use of

Glendos after changes take effect means you accept the revised

Terms.

 

Section 14. Governing Law

 

These Terms are governed by the laws of the State of Alabama,

without regard to its conflict of law rules.
